TERMS OF USE

General Terms

By downloading or using the POOLit app, these terms will automatically apply to you – you should make sure, therefore that you read them carefully before using the app. You're not allowed to copy or modify the app, any part of the app, or our trademarks in any way. You're not allowed to attempt to extract the source code of the app, and you also shouldn't try to translate the app into other languages or make derivative versions. The app itself, and all the trademarks, copyright, database rights and other intellectual property rights related to it, belong to POOLit.

POOLit is committed to ensuring that the app is as useful and efficient as possible."We reserve the right to modify or discontinue the app, or any part of its services, at our sole discretion, with or without prior notice. However, we will provide you with reasonable advance notice of any new charges for the app or its services, and we will obtain your explicit consent before applying such charges.

The POOLit app stores and processes personal data that you have provided to us, in order to provide the Service. It's your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone's security features and it could mean that the POOLit app won't work properly or at all.

You should be aware that there are certain things that POOLit will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi or provided by your mobile network provider, but POOLit cannot take responsibility for the app not working at full functionality if you don't have access to Wi-Fi, and you don't have any of your data allowance left.

If you're using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third party charges. In using the app, you're accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you're using the app, please be aware that we assume that you have received permission from the bill payer for using the app.

Along the same lines, POOLit cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can't turn it on to avail the Service, POOLit cannot accept responsibility.

With respect to POOLit’s responsibility, when you're using the app, it's important to bear in mind that although we endeavour to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. POOLit accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.

At some point, we may wish to update the app. The app is currently available on Android & iOS – the requirements for both systems (and for any additional systems we decide to extend the availability of the app to) may change, and you'll need to download the updates if you want to keep using the app. POOLit does not promise that it will always update the app so that it is relevant to you and/or works with the Android & iOS version that you have installed on your device. However, you promise to always accept updates to the application when offered to you, We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.

Definition of Key Terms

For the purpose of these Terms and Conditions:

"POOLit" or "the app" refers to the application developed and maintained by ProductStudio.
"Service" refers to the connection service provided through the POOLit app.
"User" refers to any individual who registers for and uses the POOLit app.
"Content" refers to text, graphics, images, and other material that may be created, uploaded, or shared through the app.
"Terms" refers to these Terms and Conditions.
"We," "us," or "our" refers to ProductStudio as the developer and operator of POOLit.

Age Restriction

Users must be at least 18 years of age to access or use the POOLit app. By using or accessing the Services, you represent and warrant that you are at least 18 years old. If we discover or believe that you are under 18 years old, we reserve the right to terminate your account immediately. Users who are 18 years of age but under the age of majority in their jurisdiction must review these Terms with their parent or guardian to ensure that both the user and parent/guardian understand and agree to these Terms.

User Conduct Guidelines

Users of POOLit agree to abide by the following conduct guidelines:

Treat other users with respect and courtesy
Provide accurate information about themselves and their journeys
Respect the privacy and personal information of other users
Refrain from engaging in any form of harassment, discrimination, or abusive behavior
Not use the app for any illegal purposes or to facilitate illegal activities
Not use the app to send spam, malware, or other harmful content
Not impersonate other individuals or create false identities
Not engage in any activity that could damage, disable, or impair the functionality of the app
Not attempt to gain unauthorized access to other users' accounts or any part of the app
Maintain clean, safe, and roadworthy vehicles (for drivers)
Follow all applicable traffic laws and safety regulations (for drivers)
Not transport more passengers than legally permitted in their vehicle (for drivers)
Not consume alcohol or illegal substances while interacting with other POOLit users

Violation of these conduct guidelines may result in suspension or termination of your account without notice. Additionally, we reserve the right to report illegal activities to appropriate law enforcement authorities.

Dispute Resolution

POOLit serves solely as a platform to connect users and chat with each other. We do not facilitate payments between users, provide insurance, or assume any liability related to any transactions between our users within or outside the app. All such matters are the sole responsibility of the users.

In the event of a dispute between users, POOLit encourages users to first attempt to resolve the dispute directly between themselves. POOLit may, at its sole discretion, provide limited assistance in facilitating communication between disputing users, but is under no obligation to do so.

Users agree to hold POOLit harmless from any disputes, claims, losses, injuries, or damages of any kind that might arise between users of the service. Any disputes that cannot be resolved between users should be addressed through appropriate legal channels outside of POOLit's platform.

Termination Conditions

We may terminate or suspend your account and access to the POOLit app immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to:

Violation of these Terms and Conditions
Engaging in fraudulent or illegal activities
Providing false information
Creating multiple accounts
Harassing other users
Engaging in any activity that disrupts or interferes with the service
Inactivity for an extended period
Upon request from law enforcement or other government agencies

Upon termination, your right to use the Services will cease immediately. If you wish to terminate your account, you may simply discontinue using the Service or contact us at hello@poolit.org for account deletion.

Disclaimer

POOLit does not control, endorse or take responsibility for any user content or third-party content available on or linked to by the services. POOLit cannot and does not represent or warrant that the services or servers are free of viruses or other harmful components.

You agree that the entire risk arising out of your use of the services, and any service or good requested or obtained from third-party providers in connection therewith, remains solely with you, to the maximum extent permitted under applicable law.

POOLit shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost data, personal injury, or property damage related to, in connection with, or otherwise resulting from any use of the services, regardless of the negligence (either active, affirmative, sole, or concurrent) of POOLit, even if POOLit has been advised of the possibility of such damages.

Severability Clause

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in full force and effect. Any invalid, illegal, or unenforceable provision will be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its intent. If such modification is not possible, the relevant provision shall be deemed deleted and the remaining provisions will continue to be valid and enforceable.

Changes to These Terms and Conditions

We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page. These changes are effective immediately after they are posted on this page.

Notices and Messages

By providing us with your email address, you agree to receive periodic notices from POOLit related to the Services, Updates to the services including feature updates, your account, and your relationship with POOLit.
